Our Service allows users to upload audio or video files for transcription. The transcriptions can be downloaded or accessed through our platform. The specific features and functionalities of the Service may vary over time.

3. User Accounts

3.1 Registration

To use our Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

3.2 Eligibility

You must be at least 18 years old to use our Service. By registering, you represent and warrant that you meet this requirement.

4. Use of the Service

4.1 License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service in accordance with these Terms.

4.2 Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Upload any content that infringes on the rights of others, including intellectual property rights
• Use the Service to distribute spam or other unsolicited messages
• Interfere with or disrupt the Service or servers connected to the Service

4.3 Changes to subscription terms

We reserve the right to modify subscription fees, billing cycles, or subscription features at any time. Any changes will take effect at the start of the next billing period.

Continued use of the Service after such changes constitutes acceptance of the updated terms.

5. Transcription Data

By uploading files to our Service, you grant us the right to process and transcribe the content of those files. You retain all rights to your Transcription Data, and we claim no ownership over it. However, you are solely responsible for the content you upload and must ensure it complies with these Terms and all applicable laws.

6. Payment and Fees

6.1 Fees

Some features of our Service may require payment. You agree to pay all applicable fees as described on our website. Fees are non-refundable unless otherwise stated.

6.2 Billing

We use third-party payment processors to handle transactions. By making a purchase, you agree to provide accurate payment information and authorize us to charge your payment method for the applicable fees.

6.3 Payments and taxes

Subscription fees do not include applicable taxes, levies, or duties imposed by taxing authorities. You are responsible for the payment of all such taxes.

6.4 Payment attempts

If a payment attempt fails, we may retry the charge using the provided payment method. If payment cannot be successfully processed, we reserve the right to suspend or terminate access to paid features.

6.5 Subscription & Renewal

Certain features of the Service are available on a subscription basis (“Subscription”). By purchasing a Subscription, you authorize us to charge the applicable subscription fee, including any applicable taxes, to your selected payment method.

Subscriptions automatically renew at the end of each billing period unless canceled at least twenty-four (24) hours prior to the end of the then-current period. We will charge the applicable renewal fee to your payment method on file.

Deleting your account or discontinuing use of the Service does not automatically cancel your Subscription.

7. Intellectual Property

7.1 Ownership

All content and materials on our Service, including but not limited to text, graphics, logos, and software, are the property of the Company or its licensors and are protected by intellectual property laws.

7.2 Trademarks

TranscribeToText.AI and its logos are trademarks of the Company. You may not use these trademarks without our prior written permission.

8. Termination

We reserve the right to suspend or terminate your access to the Service, including paid subscriptions, if you violate these Terms or fail to make required payments.Termination does not relieve you of any payment obligations incurred prior to termination.

9. Disclaimers and Limitations of Liability

9.1 Disclaimers

Our Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective officers, directors, employees, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another; or (d) your conduct in connection with the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

12. Changes to the Terms

We may modify these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
